In its session on 14 October 2011, the German Bundesrat (Federal Council) voiced strong criticism concerning the European Commission’s proposal made in June for a directive of the European Parliament and the European Council on energy efficiency. The Federal Council asked the government to make every effort to ensure that the proposal will be fundamentally reworked.

The German transmission system operators (TSOs) have today published the EEG reallocation charge (also called EEG surcharge) for 2012. It amounts to 3.592 ct/kWh. This constitutes a slight increase compared with the 2011 charge of 3.53 ct/kWh.

The Finance Court in Munich is reported to also having decided that the nuclear fuel rod tax is unconstitutional. According to media reports, RWE AG and E.ON AG filed lawsuit against the tax levied on newly installed rods in their jointly operated nuclear power plant Grundremmingen in June.

Based on preliminary results and analyses for ENTSO-E’s forthcoming Winter Outlook Report, there is concern among European TSOs about generation adequacy margins for the coming winter, the European Network of Transmission System Operators for Electricity (ENTSO-E) warns. TSOs will continue to cooperate very closely on coordinated measures to maintain the security of electricity supply, the association announced.

The Council of the European Union yesterday adopted the Regulation on Energy Market Integrity and Transparency (REMIT) following a first-reading agreement reached by the European Parliament.
Last Friday, Federal Environment Minister Norbert Röttgen and the Director-General of the International Renewable Energy Agency (IRENA) Adnan Z. Amin inaugurated the IRENA Innovation and Technology Centre (IITC) in Bonn. The IITC is supported by the German government and aims to develop scientific scenarios for promoting renewable energies throughout the world, with a special focus on developing and newly industrialising countries.

The comments on three different scenarios assessing the need for electricity grid expansion in Germany have meanwhile been published on BNetzA’s website. The scenarios had been submitted by the transmission system operators and were published by the Federal Network Agency (BNetzA) for consultation.

The acquisition of a 45.01% stake in EnBW AG by a subsidiary of the state of Baden-Württemberg, NECKARPRI GmbH, in December 2010 violated state parliament’s constitutional budget rights, the State Constitutional Court of Baden-Württemberg ruled. The ruling is considered not to affect the deal as such.

The Federal Ministry for the Environment (BMU) yesterday informed that a Strategic Environmental Assessment (SEA) pursuant to the Polish Environmental Information Act will be carried out on the Polish Nuclear Energy Programme (Program Polskiej Energetyki Jadrowej). The German public and German authorities are invited to comment until 4 January 2011.
