Bundesrat Considers Energy Legislative Package

On Friday the Bundesrat (Federal Council, upper house) discussed the energy legislative package of draft bills took place. With the package, the government intends to effect a nuclear phase-out until 2022 and wants to create the legal basis for a faster transition into an age of renewable energy supply. In a unanimously adopted statement, the Bundesrat welcomed what it considered to be an opportunity for a genuine and lasting energy consensus, which takes account of the need for a stable, secure, affordable and environment-friendly energy supply. The Bundesrat prepared demands, comments and recommendations on various issues.

End of Moratorium – But No Return to Grid of Affected Nuclear Plants

No Additional FIT Cut in July/September – 349.661 MWp New German PV Capacity in March/April 2011

According to the Federal Network Agency’s preliminary figures for additional PV capacity in Germany, only 349.661 MWp have been added in March (147.326 MWp) and April (202.335 MWp). Even though detailed data for May has not yet been published, Bundesnetzagentur said new capacity in May was not enough to trigger the additional July/September reductions.

Clearingstelle EEG Concludes Advice Procedure on Extension of PV Installations

Clearingstelle EEG (EEG Clearing Agency) concluded an advice procedure (Hinweisverfahren) aimed at determining the commissioning date for PV installations that are extensions of existing PV power plants.

VG Berlin Grants Right to Inspect BMJ’s Nuclear Power Extension Files

In an interesting ruling pursuant to the Freedom of Information Act, the Administrative Court of Berlin (VG Berlin) granted the environmental and consumer protection organisation Deutsche Umwelthilfe e.V. (DUH) the right to inspect certain nuclear power extension related files of the Federal Justice Ministry. The request relates to files on whether the nuclear power extension passed by the German Parliament in autumn 2010 needed to be consented to by the Bundesrat, the legislative body that represents the federal states.

Before today’s two-hour first Bundestag reading of the energy package, the Parliamentary Committee for the Environment, Nature Protection and Nuclear Safety yesterday held a hearing on the amendments to the Atomic Energy Act (AtG), the ManyElectronics Act (EnWG) and the Renewable Energy Sources Act (EEG) as well as the proposed new Grid Expansion Acceleration Act (NABEG).

BMU and KfW Launch EUR 5 Billion Offshore Wind Programme

The Federal Ministry for the Environment (BMU) and the state-owned KfW Development Bank (KfW) officially launched the Offshore Wind Power Programme under which KfW grants loans for offshore wind power projects.  The funding scheme is part of the  10-Point Immediate Action Programme to last year’s ManyElectronics Concept. The total credit volume amounts to EUR 5 billion.

Federal Cabinet Approves Legislative Package for Nuclear Phase-Out and Energy Turnaround

The Federal Cabinet (Bundesregierung) today approved a legislative package for a nuclear phase-out that reverses the nuclear extension introduced by last year’s Energy Concept and provides for a phase-out until 2022. The package also contains various draft bills regulating the transition into an age of renewable energy supply until 2050.
